To All AECS Members on Contract Terms.

Dear Agreement Service Member,

Following the Annual General Meeting in November, the AECS Council established a Localisation Committee to make recommendations on how to proceed to get the localisation policy changed.

The Committee's recommendations have been approved by Council and we will shortly start the process of trying to get the Administration to accept a change. Essentially we will advocate a change under which the Government will offer to renew the agreement of an officer who is about to be localised, if the officer is a permanent resident and he is willing to continue employment on local terms of service. Enclosed is a copy of our letter to the Secretary for the Civil Service.

please complete and promptly return the enclosed questionnaire;

if you have been officially notified of non-renewal due to localisation, please write to your head of department, copy to the Secretary for the Civil Service and to the AECS Secretary, claiming protection of the Bill of Rights Ordinance, and reserving the right to seek damages for wrongful dismissal; and

if you know the names (and addresses, if available) of persons who have been localised since 8 June 1991 (the date when the Bill of Rights became operative), please let our Secretary know.

Members who have been notified of non-renewal should keep a record of all expenses incurred that result from the job loss and a diary of all efforts made to obtain other employment. Keep this information long after you leave service because if a class action proceeding is successful you will be able to obtain compensation for all of these expenses.

After you leave Hong Kong you should keep the office informed of your address so that we can keep you informed of events.
