EPHEMERAL NOT TO HAND.
1. Just prior to your fax of 4 December, the attached letter from Building and Lands arrived with their offer concerning the resumption clause.
2. Special Clause 14 (a) remains unchanged. They have deleted subparagraphs 14(b) (i) and (ii) as identified by Miss Brooks in her minute of 15 September 1992 but with the addition of the reference to international obligations.
3. We still seem to have this contradiction of Director s discretion and international obligations. I do not think HKG cam have it both ways?
4. I spoke to Joshua Law subsequent to receiving this letter. Obviously, he had not succeeded in getting our joint proposals accepted by Building and Lands. He was told that this was a policy issue.

What do we do next? Clause 14 (b) is probably just about acceptable. I am not so sure about 14(a). There are, I suggest, two ways forward go back to HKG and state that they cannot have it both ways, eg Director's discretion and international obliyalions and ask which they want and run the risk of HKG leaving out international obligations altogether; or coming up with a form of words for 14(a) that meets our requirements. Grateful instructions.
