I have just taken over in Hong Kong Department from John Morris, who stays on as Assistant.

John has asked me to coordinate a response to your letter of 16 October which told us that Building and Lands are unlikely to allow deletion of Special Condition 14 of the Colvin House PTG. I note that Building and Lands have not completely ruled out removing Special Condition 14 - this remains our preference. I am advised that it is unusual for a development of this nature to bear the contractual risks inherent in Condition 14.

3. If it proves impossible to eliminate Section 14 in its entirety we will, as you have pointed out, need to concoct a form of word which we can live with. I have consulted Derek Savage and our legal advisers and now attach a redraft of Special Condition 14. We consider that 14 (b) (i) and (ii) are irrelevant and should be removed.

I would be grateful if you could put this redraft to Johnson, Stokes and Masters for their views. Mr Hum will be chairing a meeting of the Steering Committee on the Future Consulate General on 6 November and we would like to be able to tell him that Johnson, Stokes and Masters are now considering our proposed redraft.
