1. The new wording proposed by Building and Lands which Russ Jarvis spells out in his fax of 5 March offers a little more flexibility but, in my eyes, not enough. The original wording contained in the first draft, and which we are supposed to ignore, did not give the Director any say in the actual apportionment of the 19000 sqm. If, as it now appears, the object of the revisions is to stop us subletting commercially, that can be achieved by other means without interfering with our right to use the building for BCG, BC or ancillary purposes as we think fit. To my mind it is an unreasonable encumbrance to be dependant on the whim (to use your word) of a future SAR Director in making best use of the space which we alone will have created.

I would be interested to see Legal Counsellor's advice on Mr Hughes' interpretation of Clause 7 (not 7(a) I think?). Would bodies such as those you suggested be setting up in Hong Kong "for the purposes of the Consulate General"? I would have thought not.

3. I have copied the paragraph on Kennedy Road to Clive - I see no problem there but will let you know if MPG aren't happy.
