On (b) - Building and Lands Department appear to be trying to be flexible. They have suggested a new form of words for the last three lines of Clause 11(c):
"19000 square metres of which 6500 square metres (or such additional area as may be approved by the Director at his sole discretion) may be used by the British Council, in accordance with these conditions."
This does add a degree a of flexibility previously missing. Whether it goes far enough for HMG' = purposes is presumably a decision which will require legal advice?

On (c) Hughes feels that this covered both by Clause 11(c) for the British Council and by Clause 7(a) for surplus space generally. He pointed out the the words ".... and such ancillary space as may be required for the purposes of the Consulate-General...." and that it gives HMG the flexibility to allocate surplus space to the other British bodies as described in paragraph three YTUR. What it does not allow us to do is to let space to non-governmental organisations, ie commercial organisations, and receive any form of rent for doing so.

(iii) Kennedy Road Justice Drive Link Building and Lands Department stated that they had obtained from the Department of Transport an undertaking that pedestrian access would be maintained whilst the current situation exists, ie as the site is at the moment, and that when they came round to build the link road pedestrian access would still be maintained.
