PROPOSED PRIVATE TREATY GRANT OF THE COLVIN HOUSE SITE FOR THE FUTURE BRITISH CONSULATE-GENERAL
1.
I acknowledge receipt of your letter (77) in DLO/HW 110/NHPT/82 of 31 January 1992. Following consultations with the Foreign and Commonwealth Office in London I am instructed to state that we are broadly content with the basic terms in your letter under reference, although we have the same reservations about Development Condition (V) as we do about Clause 11 (c) of the proposed Private Treaty Grant in that over the 50 year term we believe we should have the right to allocate space, within the overall permitted total, at our discretion.

I have been asked by the FCO to acknowledge the statement in the penultimate paragraph of your letter that it is not the intention of the Hong Kong Government to create any legal obligations for the British Trade Commission or for the British Government unless and until the legal documents necessary to give legal effect to the proposed treaty grant are executed and registered, and to state that Her Majesty's Government consider that no such obligations are created until those processes are completed.
