1. IT WOULD BE A MISTAKE TO MAKE AN ISSUE OF ANY DIFFERENCE BETWEEN THE DRAFT CONDITIONS OF GRANT ATTACHED TO DLO/HKW'S LETTER OF 16 DECEMBER 1991, AND THE DOCUMENT INFORMALLY HANDED OVER TO BTC ON 28 OCTOBER 1991. IN PROVIDING THAT EARLIER DOCUMENT, WE EMPHASISED TO THE BTC THAT IT WAS FOR ILLUSTRATIVE PURPOSES ONLY, TO SHOW THE KIND OF CONDITIONS WHICH COULD BE APPLICABLE TO A PRIVATE TREATY GRANT OF THIS NATURE, AND THAT THE DRAT CONDITIONS WERE STILL BEING DISCUSSED INTERNALLY. THE BTC WAS SPECIFICALLY ASKED NOT/NOT TO RESPOND TO THAT DOCUMENT BUT TO AWAIT THE FORMAL DRAFT. WE ALSO TOLD BTC AND THE VISITING OED/HKD TEAM THAT ONCE THE DRAFT CONDITIONS WERE AVAILABLE, WE WOULD EXPECT TO HAVE DETAILED DISCUSSIONS ON THE DRAFT CONDITIONS

BEFORE THEY WERE FINALISED.

WE ARE OF COURSE AWARE OF THE POINTS RAISED IN THE VARIOUS MEETINGS THAT HAVE TAKEN PLACE AND ARE PREPARED TO CONSIDER TO WHAT EXTENT THOSE CONCERNS, PARTICULARLY THE DIPLOMATIC STATUS OF THE PREMISES, COULD BE MET WITHIN THE FRAMEWORK OF THE LAND GRANT AS APPROVED BY EXCO AND SUBSEQUENTLY AGREED IN THE LAND COMMISSION. WE THINK THE BEST WAY FORWARD WOULD BE FOR THE DIRECTOR OF BUILDINGS AND LANDS TO DISCUSS THESE TECHNICAL ISSUES AS SOON AS POSSIBLE WITH THE BTC, PREFERABLY TOGETHER WITH THE PROFESSIONAL ADVISERS HERE, AS WE SUGGESTED EARLIER.

3. WE PROPOSE THAT THESE DISCUSSIONS SHOULD ALSO COVER THE TERMS OF THE TOWN PLANNING BOARD SUBMISSION, IN WHICH WE WILL BE SEEKING THE BOARD'S APPROVAL TO USE THE EXISTING NON-BUILDING PART OF THE COLVIN HOUSE SITE (I.E. THE PRESENT CAR PARK AREA AND THE SURROUNDING SLOPES) FOR THE CONSTRUCTION OF THE PROPOSED BCG. THIS IS NECESSARY BECAUSE THE ONLY AREA CURRENTLY ZONED GOVERNMENT INSTITUTIONAL AND COMMUNITY ON THAT SITE IS THE AREA ON WHICH THE COLVIN HOUSE BUILDING NOW STANDS: THE REST OF THE

SITE IS ZONED OPEN SPACE AND ROADS.
