1 Mr Kevin Cahill, the journalist interested in the Osman case, wrote again to Sir John Coles, after a prolonged silence, on 25 October. His letter rehearses detailed arguments in relation to the case which, as Mr Cahill himself acknowledges, have been heard by the courts. There is no reason to change our long-standing policy of not commenting substantively on the case.

2 The first paragraph of Mr Cahill's letter might be interpreted as a further threat to publish the confidential telegram which has come into his possession. I therefore recommend that Sir John Coles' reply refer back to his letters of 30 April and 2 December 1991, which warned Mr Cahill of the possible consequences of such action.

3 I submit a draft reply. HKD, the Assistant Legal Adviser and Home Office concur.
