faced, and had thereby suffered grave prejudice. The

magistrate has been denied the benefit of that evidence in

the adjudicating process and the proceedings before him

have been thereby vitiated and his circumstances impugned.

The grounds identify the relevant material as being the relevant

B.B.M.B. documents disclosed on discovery and the Jalil

documents. The grounds go on to state:

"The Jalil documents show that the Ministry of Finance and

the Deputy Prime Minister of Malaysia controlled the

lending to the Carrian Group of the funds which are the

substance of the charges against the applicant.

Further,

it is evident that the General Manager of B.F.M.L., Ibrahim

Jafaar, took direct instructions from the Ministry of

Finance and was primarily responsible for the

implementation of such instructions.

From the content of these documents, as confirmed by

document Page 1 of the B.B.M.B. discovery documents, it is

apparent that the Hong Kong Government knew of the cover up

by the Malaysian Government of its responsibility for the

loans to the Carrian Group. Further in the framing of the

prosecution case and in the representation of the evidence,

all references to the political personalities who made the

crucial decisions concerning the loans, have been omitted."

The grounds add that the evidence contained in the B.B.M.B.

documents and the Jalil documents are inconsistent with the
