OSMAN : LATEST DEVELOPMENTS

1. I have been told by Mr Ziegel of Treasury Solicitors that Osman's latest appeal was dismissed by the House of Lords on 11 June. The Home Secretary signed a warrant for Osman's surrender on Monday, 15 June. Osman lodged his eighth application for habeas corpus on Tuesday, 16 June, and is also seeking leave to apply for judicial review of the Home Secretary's decision to surrender him. The Divisional Court (composed as before of Woolf LJ and Pill J) will hear Osman's applications on Monday, 22 June.

2. The FCO is apparently not involved in these latest proceedings. It may well be significant that the Home Secretary made his order for surrender while no habeas corpus application was pending, as that habeas corpus application can no longer have the effect of suspending the process of surrender. If the application for leave to apply for judicial review is refused, it is hoped that there will be no further legal bar to Osman's surrender.

3. The Home Office have apparently requested that we make absolutely no comment*(including replies to letters) until Monday's hearing is over.
