primarily upon non-disclosure by the Hong Kong Government.
Whether or not the Hong Kong Government should have
disclosed certain documents, including witness statements,
earlier than they have it certainly cannot be said that the
non-disclosure indicates a lack of good faith. In fact by
continuously making forceful representations Mr. Osman's
legal advisers have been able to persuade the Hong Kong
Government repeatedly to change its attitude to disclosure
and disclose documents which they were not previously
prepared to make available. This change of attitude does
not indicate a lack of good faith.
7.
The arguments advanced under the heading of speciality
protection and European application. The former refers to
what is to happen in Hong Kong when United Kingdom
sovereignty over Hong Kong expires on 1st July, 1997. The
latter refers to the application which is now pending
before the European Commission of Human Rights on behalf of
Osman which is based upon an alleged infringement of
those rights by
