151. M. Siméon concluded that the meeting was most useful and was assured by De Touzalin that the Court would now look at the statement of facts and memorandum for the purposes of characterisation under French Law.
152. On the 14th of September 1989 a schedule was sent to De Touzalin itemising
the typos within the charges. (Annexure "N").
Second Hearing At Chamber D'Accusation De Versailles - 16.10.90
153. On the 16ht of October 1990 after returning from evidence gathering in the United States I attended the Saniman hearing at the Chambre de Accusasion at the Cour d'Appel de Versailles. A most disturbing thing occurred before the Court resumed. M. De Touzalin approached me and asked whether or not it was true that George Tan had been acquitted of the BMFL charges. I assured him that had not happened. He said that there had been written representations to the Court by Saniman's lawyers to this effect. He then showed me a newspaper article which was a photocopy of the front page of the South China Morning Post. This photocopy had been enlarged so as to have the date deleted. It was a headline announcing the acquittal of George Tan. It related to the Carrian trial. I explained to M. De Touzalin that this was a separate trial at an earlier date and was totally independent of the BMFL charges. M. Stasi appeared to suggest to De Touzalin that I was misleading him and that he could not rely on the Hong Kong Government in any event. Notwithstanding de Touzaline did submit to the Court that Saniman's lawyers were misrepresenting the true position in respect of George Tan. Please find enclosed herewith notes of the hearing.
