First Hearing Before Chambre D'Accusation De Versailles - 26.06.90

130. On the 26th of June 1990 we attended the Chambre de Accusasion in Versailles. The charges and allegations were read out to Saniman and he applied for bail. I recall Saniman saying something about his fearing for his life and that those involved in the fraud had already murdered the President of the Law Society and a manager of the Bank in Hong Kong. Saniman's lawyers said that they were seeking to have the matter adjourned until

and papers prepare September because they needed time to consider the Saniman's defence.

131. The Chambre D'accusation retired for some time to consider the question of ball. Eventually when they returned they allowed Saniman bail under Judicial control but it was clear that there was some reluctance on their part to do so when it was only the lengthy remand that at the end of the day tipped the scales in Saniman's favour. The matter was adjourned to the 11th of September 1990 for hearing.

132. We delivered the note to De Touzalin who was quite prepared to accept it and in turn as a matter of courtesy furnished us with a copy of his requisitions that he had filed with the Court on that day. I was concerned that De Touzalin was able to in just over two weeks summarise his views in relation to the fresh request in the form of requisitions. I was even more concerned once I had read the requisitions.

133. De Touzalin had no difficulty with the statute of limitations and no difficulty with fresh facts but his reasons for refusing the US$292 million and others and only allowing the US$138 and US$100 million appeared to me not only shallow but self contradictory.
