"REQUITE GRACIEUSE” TO THE FRENCH GOVERUDIENT
EREK TRANSLATION (XII)
I have the honour hereby to ask you, on behalf of the Government of the United Kingdom of Great Britain and Northen Ireland and of the Governor of the Colony of Hong Kong, to reconsider the decision notified in the note of 21st March 1992 whereby you have refused to extradite Mr Rais Saniaan, a Malaysian national.
This letter, which must be analysed as a "recours gracieux", is based on the following.
I.
THE FACTS
Further to serious facts set out in the Annex hereto, the extradition of Mr. Rais Saniman to Hong Kong for trial was requested. On 4th November 1987, the Chambre d'Accusation of Paris issued a negative advice.
But upon a new request, the Chambre d'Accusation of the Court of Appeal of Versailles, on 30th October 1990, so decided :
"The Court !
With respect to the counts of indictment number 5, 9, 21, 22 and 23:
acknowledges that action interrupting prescription took place before this request for extradition;
says, with respect to 4th November 1987, that there is no re judicata;
