We share the widespread concern about the length of time taken to bring this case to a conclusion but as the judgement quoted above makes clear, the Secretary of State is unable to act while such proceedings are pending. He will reach a final decision as soon as he is able to do so, taking into account the representations submitted on Mr Osman's behalf. Any question of discontinuing Mr Osman's prosecution would be a matter for the Hong Kong authorities.
