Incompetence within the HK prosecution service. (contradicted by the Jalil letter etc, but supported by the manner in which the case has now run outside the control of politicians and civil servants.)
4. Prejudice and bias in the UK judiciary, which may have been directed in its approach to the case by policy guidelines laid down in Privy Council papers sent to the judicial committee as apparently routine PC papers.
5. A complete failure by the FCO and No 10 to understand the changed climate in the UK and in Parliament in relation to the law and individual rights. A further failure of analysis by both HK and the FCO, in relation to the consequences of the legal process of discovery, and yet a further failure to understand that all the documents would almost certainly surface at any trial in Hong Kong.
6. None of the above and a far more sinister motive, arising from the arms traffic via the UK, the payoff's described in the Observer, and private payoff's to politicians and political parties, some outside Malaysia.
7. All of the above.
8. Natural conclusion. A full scale Parliamentary enquiry with no hostages taken and no immunities granted. No PIIC concessions, no in camera proceedings and no hiding place for any party named in the papers, cables etc.
At the close of business tonight over 100 Parliamentary candidates had joined the 52 MP's who have signed the EDM's, and the 200 Parliamentarians who have written to Minister's about the
case.
On Monday the Chairman of the Bar Council took the unprecedented step of indicating that he will take the case to the Home Secretary, as soon as one is appointed after the election. Simply put, the Crown has lost the Bar on this case. As I happen to know, the case has been perceived as a scandal within the Bar for over a year.
