circumstances have not changed. However, a further short

certificate reaffirming the validity of Mr Maude's

certificate would be a sensible precaution and such a certificate is being prepared. If Lord Caithness is invited and agrees to sign such a certificate our legal advice is that it will be necessary for him to read the (69) documents

in question.

7. As noted, this matter is quite distinct from the booklets published by Kevin Cahill. The only possible link

is that in the fourth application seeking PII for the nine

documents which had been formerly disclosed, it was relevant

heen that there had not sufficient public dissemination of the documents to deprive them of the protection of public interest immunity. It could conceivably be argued on behalf

of Osman that because of Cahill's booklet there has now been

a greater degree of dissemination so that PII can no longer

be claimed. Treasury Counsel said on 18 February that he

expected the Court to have no sympathy for such an

argument.

I think the advice is mijl.

I am ready to have to mich the "inister to read the 69 document's, but in

this matter it is best to follow the text concerted advice of the lawyers.
