Comment no 5 to proposal for amendment to the Aliens Act
Right to residence permits for Hong Kong citizens
If it is decided to grant residence permits to Hong Kong citizens employed by Danish companies in Hong Kong, such permits would be issued in pursuance of Section 9(2)3 of the Aliens Act.
A condition for introducing such a right specifically applying to Hong Kong citizens must be that only senior employees will be eligible. Another condition must be that the Danish companies concerned have undertaken to employ the people concerned for several years.
The group of senior employees should already now be offered one-year multiple-entry visas, which would allow them to go to Denmark whenever they want. The people concerned should also be informed that they will be granted residence and work permits in Denmark provided that their employer can find work for them here and the Ministry of Industry estimates that their business positions are such as to justify the granting of a residence and work permit.
One way to implement such a scheme in practice would be to let the Ministry of Foreign Affairs in collaboration with the Consulate General in Hong Kong prepare lists of eligible senior employees.
