We consider that public consultation would be inappropriate. We have already consulted the Chinese in principle as stated in paragraph 9 and we will inform the NCNA of the general guidelines of our prosecution policy.

PUBLIC REACTION

We do not expect strong public reaction to the proposals. However, some may comment that jailing overstayers who cannot pay their fines might worsen the overcrowded situation in prisons.

PUBLICITY

We will issue a press statement and a Legislative Council brief. A spokesman will handle enquiries. We will reinforce the message with posters at immigration check points, and by broadcasting messages over the radio.
