The way in which the quotas for the 4 classes of the BNS are set out in Article 5 of the Schedule to the British Nationality (Hong Kong) (Selection Scheme) Order 1990 (hereafter the Schedule) has effectively debarred us from allocating the unused quota of OGIN to any classes other than the GOC. Similarly, the unused quota for the Police can only accrue to the DSC quota for the second phase. The law is however silent as to whether the unused quota in an OG in a tranche should be carried over to that OG exclusively in a subsequent tranche.

It is recommended that the unused quota of OGIN in the first phase should accrue to the overall GOC quota for specified OGs in the second phase and should be allocated among these OGs according to the criteria to be determined. This would not affect the quota of 500 for approved occupations (AOs) under the scheme as set out in para 10(1) of the Schedule. Among the 500 places available for the 6 AOs, 400 have been earmarked for the first phase by virtue of a direction given by the Secretary of State. The balance of 100 places will be distributed in the second phase among the AOS to be determined by the Governor. By the same token, it is recommended that any unused places of the Police in the first phase should be carried over to the DSC quota as a whole for the second phase.

As mentioned above, the overall quota for the second phase will not be finalised until after all applications in the under-subscribed OGs have been processed. Annex 1 gives a rough estimate of the overall quota and its distribution among the 4 component classes.
