Problem

1.

HK telno 2016 sought our advice on how to arrange for

over 3 million BDTCs to register as BN (0)s before the 1 July

1997 deadline, so as to avoid a last minute rush of

applications in 1997. Discussions between FCO and Home

Office Legal Advisers have revealed that the relevant

legislation is flawed. What to do?

Recommendation

2. I recommend that we give Hong Kong our legal advice so they can press on with their advertising campaign, and

that officials should then consult on how to amend the

legislation, and I submit a draft telegram. A Legal Adviser

has been consulted and is content. Home Office concur.
