On the assumption that the nationality

requirements for Article 48 (4) public service

posts cannot include citizenship of other

independent States, there would appear to be three

possible approaches.

h Confidence

(a) British Citizens Only

Restricting the public service "core" to the

category of nationality indicating the closest

connection with the UK, would presumably ensure

compliance with the ECJ's definitions of public

service posts.

FCO nationality requirements for Diplomatic

Service and Home Civil Service posts - all of

which it is submitted fall within the Public

Service Corps are currently restricted to this

category.

(b) "UK Nationals" as Defined for EC Purposes

In a declaration (Official Journal C23/1,

28 January 1983) issued in the Council of the

European Communities the UK Government stated that

terms such as "nationals" or "nationals or Member

States" when used in the EC Treaties or other Acts

with respect to the United Kingdom referred stock No. C002B
