THE PROBLEM
We propose to formally sign an agreement with Malaysia for reciprocal assistance relating to the investigation and prosecution of drug trafficking and the confiscation of the proceeds and instrumentalities of drug trafficking.

RECOMMENDATION AND ADVICE SOUGHT

To give effect to the reciprocal Agreement, it is recommended that under section 28 of the Drug Trafficking (Recovery of Proceeds) Ordinance, the Drug Trafficking (Recovery of Proceeds) (Designated Countries and Territories) (Amendment) Order 1992 at Annex A should be made, subject to the approval of the Legislative Council by resolution.
