ARTICLE 4 JURISDICTION
(1)
Surrender may be refused for an offence which is
regarded as one over which the requested Party has
jurisdiction.
(2) If surrender is refused pursuant to paragraph (1),
the requested Party shall submit the case to its
competent authorities with a view to causing the
fugitive offender to be proceeded
to be proceeded against under its
laws.
