Arrangements for the Recíprocal Recognition and Enforcement of Civil Judgments in Civil
and Commercial Matters
INTRODUCTION
It is
important,
in
the
interests
of the
community as
a whole,
but
for
local
businessmen
in
particular, to have an effective scheme which enables money
judgments obtained
other jurisdictions
1997.
have
in
Hong Kong to be easily enforced in
and vice versa both before and after
The British side have examined the situation and concluded that the most appropriate scheme would be
international bilateral
agreements between
one based on
Hong Kong and
other relevant jurisdictions.
We are
therefore seeking the agreement of the Chinese side to our
proposal
that, on the basis of the draft Model Agreement in
the
Annex
Hong Kong hereto,
should
agreements
recognition
with selected countries
negotiate bilateral
the on
reciprocal
and
enforcement
of
judgments
in civil and
commercial
matters that will continue to apply after 1997.
A list of
potential partners
be will
provided to the
Chinese side in due course.
