and search and, if necessary, arrest and detain any person found in
a
blic place
(a)
who acts in a suspicious manner;
(b)
whom he suspects of having committed, or of intending
to commit, any offence.
The proposed section 54 (1) relates to a person found in a public
place who acts in a suspicious manner and provides that a police
officer may
(i)
(ii)
stop the person for the purpose of demanding that he
produce proof of his identity for inspection;
detain him for a reasonable period while the officer
enquires whether he is a suspected offender; and
(iii)
if necessary, search him for anything that may
present a danger to the officer.
8. The proposed section 54 (2) relates to a person found in a
public place who is reasonably suspected of having committed, or of
intending to commit, any offence. It provides that a police officer
has the same powers as are referred to in paragraph 7(i) and (ii)
above, and may also search the person for anything that is likely to
be of value to the investigation of any offence that the person has
committed, or is reasonably suspected of having committed or of
intending to commit.
9.
Clause 5 repeals section 56, which empowers a police officer,
in certain circumstances, to stop and detain any person removing
furniture from premises.
