THE PROBLEM

The Hong Kong Bill of Rights (BOR) Ordinance

1991 was partially implemented on 8 June 1991 but any

repealing elfects that there might be on

the Prevention of

Bribery Ordinance, Chapter 201 or the Independent

Commission Against Corruption (ICAC) Ordinance, Chapter

204, were avoided as result of a stipulated one year

a

"freeze" period. During this period of grace, a

comprehensive review has been undertaken of both ordinances to identify provisions which obviously conflict with the

BOR in an attempt to ensure compatibility.

RECOMMENDATION AND ADVICE SOUGHT

it is recommended that the Prevention of

Bribery (Amendment) Bill 1992 and the Independent

Commission Against Corruption (Amendment) Bill 1992 at

Annex A and Annex B respectively, should be introduced intu

the Legislative Council.

Members are asked to advise whether this

recommendation should be approved.
