Despite your diligent researches, I wonder whether they deal with the main point at issue in this case. As I understand it, the Hong Kong authorities have made a practice of refusing approval for flights from Hong Kong to Macau unless the permission of the PRC has first been obtained. question was whether it was accepted international practice for one State to withhold its permission for a flight to a particular destination until the permission of the States over which the flight will transit has been obtained. In other words, if a helicopter wishes to fly from Brighton to Brussels, would the CAA refuse permission until they knew that French approval had been given? It may be that in the case of the UK this problem does not arise, because we do not require approval for such flights, but the CAA may be able to say whether such a practice is common in other parts of the world.
