I was sorry not to get the chance to see you when

you visited Hong Kong earlier this year.

I believe during your visit the question was raised of the status of Cathay Pacific Airways, and the other Hong Kong airlines, Dragonair and Air Hong Kong, as regards security arrangements and in particular the inclusion of CPA on a list of "Overseas Airlines" attached (at Annex B) to Security handbook used by your directorate. I am not familiar with all the names in the list but it appears that CPA is the only British carrier included and I understand that, because of its inclusion in the list, is regarded as a foreign carrier.

We have taken legal advice here on the position since Hong Kong has a number of its own Air Services Agreements each of which includes a Security Article. There is therefore the risk of confusion as to whether or not CPA is still a UK carrier for security purposes. Hong Kong has, for example, its own ASA with Malaysia which includes a Security Article, but designation of Hong Kong airlines to operate scheduled services under this agreement is the responsibility of the Hong Kong Government, not HMG.
