AVIATION AND MARITIME SECURITY ACT 1990: AVIATION LEGISLATION:

EXTENSION TO HONG KONG

I believe you have now agreed to take over the draft of the above legislation from Andrew Young.

2. This long running saga came to a head recently when Dr Patrick Hase, Principal Assistant Secretary on Aviation Security for the Hong Kong Government, came to London on a familiarisation visit. One of the purposes of his visit was to see if this legislation could be drafted and put before the Privy Council in the last two months of this year. Dr Young explained at a meeting in Security Coordination Department on 28 October that, because of the inclusion of the Dependent Territories and the Privy Council had a fairly full agenda up until the end of this year, it would almost certainly not be possible to put anything before the Privy Council until at least early in the New Year. I enclose a copy of the record of the meeting.

3. Dr Hase then asked if it would be possible for the aviation legislation for Hong Kong to be handled on a separate basis and therefore put through the Privy Council in quicker time. Dr Young thought this might be possible and I should be grateful if you could let us have your comments on this proposal, and if you think it will be possible to let the Hong Kong Government have an Order in Council before the end of January 1993.

This will mean that the Aviation legislation for the dependent territories will have to be put through the Privy Council in slower time. In any case we have yet to receive their suggested amendments to the draft and we are now chasing these.

5. You should know that we are again discussing with Aviation and Maritime Department on who should be leading the maritime aspect of the legislation. We will keep you closely informed on
