MERCHANT SHIPPING ACT 1894

We are proposing to repeal Section 238 of the Merchant Shipping Act 1894 and subject to the views of Dependant Territories will proceed with the repeal quickly.

The background relates to the somewhat archaic practice of recovering seamen deserters in the United Kingdom and forcibly returning them.

The United Kingdom has signed but not yet ratified The Abolition of Forced Labour Convention 1957 proposed by the International Labour Organisation (an agency of the United Nations). The delay in ratification has been caused by a number of bilateral agreements which have now largely been terminated.

As regards UK legislation, the 1894 Act originally applied in the UK and all colonies. In 1970, it was replaced in the United Kingdom by Section 89 of the Merchant Shipping

The Merchant Act 1970, but continued to apply in colonies. Shipping Act 1988 provided for the repeal of Seciton 89 of the 1970 Act, but the repeal has yet to be activated. Now with the termination of the remaining bilateral agreements all that remains is to repeal the section regarding dependant territories and the United Kingdom can then ratify The Abolition of Forced Labour Convention 1957.
