Piracy in South East Asian Waters

Thank you for your fax of today's date.

At MSC 60 in April, the Secretary-General was asked to raise the matter of piracy direct with the UN Security Council. This was however rejected on the grounds that such action would not be appropriate and that an approach to the Security Council could only be initiated by a UN Member State. The UK (at least) has taken no such action.

The S-G was however directed to invite the coastal states "to advise MSC 61 as to measures they were taking to implement resolution A.545(13)". You will of course immediately recall that this resolution "Urges Governments to take, as a matter of the highest priority, all measures necessary to prevent and suppress acts of piracy and armed robbery against ships in or adjacent to their waters including strengthening of security measures" The resolution goes on to invite "Governments and organizations concerned

concerned to inform the Organization of action taken to implement the aims of the present resolution".

The Secretary-General's letters were not sent until 15 and (not surprisingly) no replies have yet been Indeed, none are expected until the end of July at the It would therefore be premature to consider action along the lines suggested by HKSOA. Indeed, the IMO Secretariat consider that the Secretary-General would be unlikely to contemplate any personal approaches until after MSC 61 has considered the matter in December.

There is the possibility that should the S-G be scheduled to go to Indonesia, he might raise the piracy issue informally with President Suharto but at present, there is no possibility of the S-G making a visit to Indonesia for this specific purpose. If you wish, I will approach the IMO to see if Mr. O'Neil has any intention of visiting Indonesia in the future.
