RESOLUTION of the Government of Colombia, respecting the Free Transit of Arms and Munitions/of War across the Isthmus of Panamá.—Bogotá, October 16, 1884.

To the Home Secretary of the State of Panamá.

THE Executive Power has resolved to re-establish on the Isthmus of Panamá the absolute liberty of universal transit, which it had restricted in consequence of the late international war on the Pacific, and the recent civil disturbances in Equator, in regard to munitions of war destined for the respective belligerents. But, bearing still in mind the difficulties which arose in the year 1879, when it issued its Decree "Resolucion ") of the 2nd June,* the Executive Power desires, whilst making to you the present com munication, to recommend, most particularly, to the Government of that State the strict observance of the stipulations contained in the existing Treaties between Colombia and the Southern Republics, and of the general principles of international law, in whatever difficulties may arise, so that the Government of Panaina may, as the constitutional representative of that of the Republic, whilst submitting the matter to the superior judgment of the Chief of the Federal Administration, be guided in its action by the spirit of inter- national reciprocity contained in the said Treaties and principles, and by the spirit of justice and equity by which Colombia aspires to a place amongst civilized nations.

It is needless to tell you, for it is implied by the text itself, that the Executive Decree ("Resolucion ") of the 2nd June, 1879,

to which I have referred, is not abrogated by the Resolution embodied in this note, since the said Decree, in any future contingency-which may it please Providence and the good sense of nations to avert! will always serve as a guide to us in the cases to which it refers; but it is suspended in its effects, as its provisions are uncalled for now, in view of the fortunate termination of the state of war between the belligerents on the Racific and their return to their former friendly relations, and the re-establishment of peace within the territory of Equator. Colomba being, therefore, exonerated from its obligations of neutrality, ever unpleasant, inasmucli as they convey the idea of civil or international wars, of which the said neutrality is the consequence, accepts willingly, in their stead, the
