ASSOCIATION OF COMMONWEALTH UNIVERSITIES

Thank you for your letter of 19 May enclosing draft Charter amendments from the Association. You have asked me for my informal comments on them, in particular on the proposed new Article 4(ii). You have also asked me to explain the difference between 'situate in the Commonwealth' and 'member of (the?) Commonwealth'.

I think the first point to make is that it is questionable whether Hong Kong is a 'country However, the Charter of the Association uses the term country' and, since the association is a non-governmental organisation, I do not think it greatly matters. I have no difficulty with any of the proposed amendments to the Charter and Statute. However, I wonder whether Statute 2(2) also needs to be amended. It occurred to me that, with the renumbering of Statute 1, it may be necessary to amend Statute 2(2) to read paragraphs (2) to (6)'.

I have asked Mr Bunten, Hong Kong Department, to whom I am copying this letter to pass all the relevant correspondence to the Hong Kong Government in case they have comments on the policy whereby the University of Hong Kong may continue to remain a member of the Association after 30 June 1997.

As to your question about the difference between. situate in the Commonwealth' and 'member of the Commonwealth', the phrase 'situate in the Commonwealth' is a phrase which appears in the existing Charter and it
