Ministerial Responsibility
3. The Secretary of State for Foreign and Commonwealth Affairs
has overall responsibility for general matters with the UK's
relations with Brazil and the Community. The Secretary of
State for Trade and Industry has an interest in some areas of
the agreement.
3. Legal and Procedural Issues
(i)
Legal Basis
The agreement is based on Articles 235 and 113 of the Treaty
of Rome.
(ii)
Cooperation Procedure
Under Article 235 EEC the Council is obliged to consult the European Parliament.
(iii) Voting Procedure
The Council is required to act by unanimity under Article
235/EEC.
