STATEMENT BY THE COMMISSION ON THE CANADA CLAUSE

"The Commission considers it inopportune to include in a co-operation agreement

between the Community and a third country a provision concerning the respective spheres of competence of the Community and its Member States.

The Commission further notes that no Member State concluding an co-operation agreement makes provision for the insertior of a clause stipulating, for example, that the said agreement in no way affects the powers of the Community to undertake Community co-operation activities and to conclude Community co-operation agreements with the third country in question.

Finally, it is the Commission's opinion, particularly in view of the evolutive nature of the Community co-operation provided for in this agreement, that the phrase "and any action taken thereunder" in the Canada clause cannot in any way prejudice the dynamic development of the co-operation undertaken and to be

undertaken by the Community with Brazii.".
