permanent reservations in sections 9 to 13 of

the Bill of Rights Ordinance should be repealed and the United Kingdom should withdraw its

corresponding reservations to the International Covenant on Civil and Political Rights."

Their

Comment: Sections 9 to 13 mirror the reservations

made by the United Kingdom Government in

' applying' the Covenant to Hong Kong. repeal would be dependent upon the reservations

being withdrawn. The Joint Declaration states

that the provisions of the Covenant as applied to Hong Kong shall remain in force. The Covenant has

to be taken as SO applied, i.e. with the reservations to which it is subject.
