S K TANG BEQUEST

1. I thought I would let you know the present situation regarding the S K Tang Bequest. It has been referred to Hong Kong under the advice of the Charity Commission who finally replied to our letter of May 1991 in April 1992. The Charity Commission have advised that the Attorney General in Hong Kong should establish a Sign Manual with a Scheme set up under that to administer the Bequest. This is contary to the advice we were given in 1990 which said a Scheme could be set up by the Charity Commission alone. Our Legal Advisers agree with the new advice and we have now put it to Hong Kong for their news.

2. I also raised with Legal Advisers some of the points which we had discussed on the phone including whether the division of funds could be altered to provide the Scholarship Scheme with a larger portion. The answer to this was that it would be against the wishes of S K Tang. As to the question of whether Cancer Research could start to receive funds from Hong Kong, it was suggested that we raise these matters with HK when we start looking at the Scheme itself.

3. It is rather frustrating that so much time has been wasted barking up the wrong tree but I am hopeful that we will now be able to sort things out. Do let me know if you have anything you wish to suggest, I plan to write to Mr Smith-Laitten for his comments aswell.
