The Administration no doubt hopes that publication of the preliminary list will convince enough Senators that it means business to avoid a veto-proof majority for the bill to deny MFN to China, which should receive a Senate floor vote in September. Conveniently, Congress is scheduled to have adjourned before the deadline for a decision on whether or not to retaliate has to be announced.
