THE PROBLEM

Gaps have emerged in our security export control system as regards items which might be used for nuclear, chemical, or biological weapons (NCBW) purposes.

RECOMMENDATION AND ADVICE SOUGHT

It is recommended that, under section 31 of the Import and Export Ordinance, the Import And Export (Strategic Commodities) (Amendment) Regulation 1992, at Annex, should be made.

Members will be asked to advise whether this recommendation should be approved.

BACKGROUND AND ARGUMENT

The import and export of strategic commodities to and from Hong Kong are controlled under the Import and Export (Strategic Commodities) Regulations made under the Import and Export Ordinance. The items under control are listed in schedules to the Regulations. Hong Kong's control lists are modelled on those of the United Kingdom and comply with various international security export control regimes.
