Amendments to the Royal Instructions and Letters Patent

This is just to let you know how things are progressing at our end.

As mentioned in my letter of basically content with the draft amending instructions enclosed with your letter of 6 October.

We note, however, that no amendment is proposed for Clause XXIV of the RI which provides that every ordinance, vote, etc which creates a charge on public revenue "shall be proposed by the Governor, unless the proposal of the same shall have been expressly allowed or directed by him."

advice on what, if any, amendments are necessary to preserve the Governor's right under Clause XXIV consequential to his stepping down as LegCo President.

We hope this issue can soon be clarified; in the meantime, if you or the FCO Legal Advisers have any advice in this respect, we would also be pleased to hear them.

submission to the Privy Council, we would wish to go for the meeting on 17 November provided we can settle Clause XXIV of the RI in time. When is the deadline at your end?

If the November date is no longer realistic, we are content with 17 December as a fallback. We would be happy to be guided by your advice.
