President of the Legislative Council shall be elected from amongst the Members of the Council set out in LP VI (new) (c) and (d) by the Members of the Council set out in PL VI

(new) (c) and (d).

(The purpose of the above is to stop an Ex Officio from being elected or taking part in the elections)

delete all of this subclause and substitute it by something like

" In the absence of the President from a meeting there shall preside at that meeting-

(a) a Member of the Council who is not an Ex

Officio member of the Council and who has been elected by the members of the Council specified in RI XXI (i) to preside on such occasions"

Hmm. Should this remain as it stands? Might it be more appropriate for the RIS to say that the Legislative Council should be in session for not less than (say) 9 months and leave them to decide exactly when? The Basic Law does not seem to make any provision.

RI XX1A (2) Hmm. Is the Governor summonsing the Council in his capacity as Governor or as President? (I note that the Basic Law (BL 72 (4) confers this power on the President.) Even in his capacity as Governor, is this still an appropriate clause? But this does atleast give him the power to summon LegCo. I think we better ask Hong Kong.

How will the Governor "propose " a measure if he is no longer a member of the Council? I guess we do not have a problem until 1995 because there still are 3 Ex Officio members.
