10.-(1) A person guilty of an offence under any provision of this Act Penalties. other than section 8(1), (4) or (5) shall be liable-

(a) on conviction on indictment, to imprisonment for a term not
by incredvig & 100000 exceeding two years or a fine or both;

(b) on summary conviction, to imprisonment for a
exceeding six months or a fine not exceeding $50000 or both.
(2) A person guilty of an offence under section 8(1), (4) or (5) above shall be liable on summary conviction to imprisonment for a term not exceeding three months or a fine not exceeding 2 to or both.

Arrest, scarch and trial. 1984 c. 60.
(1) Section 9(1) of the Official Secrets Act 1911 (search warrants) shall 1911 c. 28. have effect as if references to offences under that Act included references to offences under any provision of this Act other than section 8(1), (4) or
(5).
(2) Section 8(4) of the Official Secrets Act 1920 (exclusion of public 1920 c. 75. from hearing on grounds of national safety) shall have effect as if references to offences under that Act included references to offences under any provision of this Act other than section 8(1), (4) or (5).

12.-(1) In this Act "Crown servant" means-
an orice oernelnment, (a) a person holding
whether pennant or
temmptrany, under the Crown in right of the Govement of Hong Kong; (b) any person employed in the civil service of the Crown including Her Majesty's Diplomatic Service Her Majesty's Overseas Civil Service
