This note informs Members of our revised proposals for legislative measures against organised crime.

BACKGROUND

On 14 April 1992, having considered memorandum XCCI(92)15 on proposals to combat triad activities in Hong Kong, the Council ADVISED and the Governor ORDERED that (inter alia) a further submission should be made to the Council outlining the broad principles enshrined in the Bill, the major revisions made to the Bill following receipt of public comment during the consultation exercise and any significent issues as yet unresolved within the Administration.

ORGANISED CRIME BILL 1991

Legislative proposals were published in August 1991 in the form of a White Bill and explanatory paper. The aims of the Bill were -

(a)

to deter organised criminal activity by heavy penalties;

(b)

(c)

to make possible the effective prosecution and punishment of individuals who participate in such activity at all levels; and

to destroy the power of criminal syndicates by confiscating their criminal profits.
