LOCALIZATION OF THE JUSTICE OF THE PEACE SYSTEM

1. Hong Kong have sought our views on a proposal to amend

the Letters Patent and to make local provision for the

Governor's power to appoint Justice s of the Peace (JPs). If we are content in principle, Hong Kong will consult ExCo

and then consult the Chinese before formally asking us to

amend the Letters Patent. The details of the proposal are

set out in Hong Kong telno 1034, attached.

2. Our Legal Advisers have no difficulties with the

proposal from their point of view.

Peking also see no

objection, though they have flagged up that, for symbolic

Chinese reasons, the Amay not wish the system to continue beyond

This should not be a particularly contentious issue, and I see no difficulty with the proposal in principle. Subject to your views, I propose to issue the attached telegram. do not think it is necessary to involve Ministers at this

stage: but Ministerial approval will be required later for

the amendments to the Letters Patent.
