It is envisaged that the Law Society will deal with all applications for registration and will handle all matters, and paperwork, involved in the registration arrangements, and monitor compliance with the Scheme generally, both as regards applications from individual foreign lawyers and as regards applications from foreign law firms.
In the Committee's view, the Law Society should be vested with discretion to allow or refuse an
application, to waive one or more criteria and attach conditions to registration, having regard to representations made by
e.g. the Attorney General and the Immigration Department.
The
particular features of the Scheme, insofar as they concern individual foreign lawyers, foreign law firms, associations between local firms and foreign law firms
and
local practice rights, are set out briefly in the following sections of this Report.
