Retirement : Authority

I refer to your letter of 30 January 1992, addressed

to Mr Wiggham, and my interim reply of 3 February.

I have been advised by the Attorney General's Chambers that the provisions of Section 10 of the Pension Benefits Ordinance, Cap 99, do no more than prescribe the retirement age for the purposes of that Ordinance, but do not provide that all serving.officers have security of tenure until they attain that age and that, in the absence of specific provision to the contrary, serving officers continue to hold their offices at Her Majesty's pleasure signified in this case by the decision of the Secretary for the Civil Service in the exercise of the authority delegated to him by the Governor.

I therefore confirm that you will accordingly cease active service to proceed on pre-retirement leave with effect from 1 November 1992 as stated in my letter of 7 June 1991 to you.
