I have recently received a copy of Secretariat Internal Circular No. 4/91, dated 4.6.91, reference CSO/ADM CR 4/3221/90 (91) Pt. 2, on the subject of "Delegation of the Governor's Power of Appointment".

Paragraph 1 of the circular quotes Article XIV of the Hong Kong Letters Patent 1917 to 1990, which provides that

"The Governor may

appoint such

public officers as may lawfully be appointed, all of whom shall, unless otherwise provided by law, hold their offices during our pleasure."

As an officer serving under the Pension Benefits Ordinance, Cap. 99, in my case it is "provided by law" in section 10 thereof that

"The retirement age of a serving officer

shall be when he attains the age of 60 years

Section 10 is the only one which stipulates retirement age, and is in fact so headlined.
