Disciplinary Proceedings Which May Affect

the Compensation of an Eligible Officer

26.

If disciplinary proceedings are taken, or are about to be taken, against an eligible officer and those proceedings might lead to his dismissal, the payment of compensation under this Scheme shall be withheld pending the determination of those proceedings.

27.

Where any eligible officer is dismissed, he may, if the Governor so directs, be required to refund any compensation that he has received, and any compensation which would otherwise be due to him may be withheld.

General

28.

Any compensation or gratuity payable under this Scheme to an officer or to his legal personal representatives or dependants shall be paid when due in accordance with any requests made from time to time by. such officer, his legal personal representatives or his dependants, as the case may be, in Hong Kong or such other country/place outside Hong Kong as the officer or his legal personal representatives or dependants may select. Payment shall be made in the currency of the country in which payment is to be made; and where payment is to be made in a country/place other than Hong Kong the amount of the payment shall be such as the amount in Hong Kong dollars will produce at the rate of exchange prevailing at the date of payment.

29.

Total compensation shall be calculated to the nearest HK$1 and all payments of compensation shall be made to the nearest HK$1.
