You ask me what, once the Secretary of State's approval has been given to amend the Colonial Regulations, we do about seeking the Secretary of State's approval for the Governor to delegate the power to retire officers. I think we have sought the Secretary of State's approval for the Governor to delegate the power to retire officers in the past, but please check back on past papers; I seem to recall something in early 1991, although I may be confusing with the delegation of the power of appointment. Unfortunately, the Letters Patent, Article X1V (ii) will not help us because this provision only enables the Governor's powers of appointment of judges, JPS and public officers to be delegated. Subject to Hong Kong's views, I think we will need to submit to the Secretary of State, after he has given approval for the amendment of the Colonial Regulations, seeking his approval for the Governor to delegate the power to retire officers. We need to ask the HKG to whom the Governor would delegate the power and whether they would wish the persons to whom the powers were to be delegated to be set out in the approval to be given by the Secretary of State.
